These rules are incorporated into and incorporate the Services Agreement, to which all participants must agree in order to register and participate.
ELIGIBILITY: The $12,256 Holiday Stay Strong Sweepstakes (the “Sweepstakes”) is open to: [1] legal residents of the fifty (50) United States or the District of Columbia; [2] who are 18 years of age or older at time of entry; [3] and who are registered users of HealthyWage; and [4] who have the three (3) conditions listed in the “To Participate” Section below (the “Entrant” or “You”). The following people are not eligible to win the Sweepstakes: Employees of HealthyWage LLC (the “Sponsor”), its affiliates, advertising agencies, prize suppliers, and the immediate families (spouse, parents, children, siblings and their respective spouses) (collectively “Releasees”,) and individuals living in the same household as such employees. The term "Releasee" shall also include the Sponsor. Sweepstakes is subject to all applicable federal, state and local laws. Void where prohibited by law.
TO PARTICIPATE: To participate an Entrant must have: 1. A mobile device. Data rates may apply. Consult with your carrier for fees. 2. The HealthyWage App downloaded onto your web-enabled mobile device. If you do not already have the HealthyWage App on your device, visit the application store for your mobile device and download and install the HealthyWage App (the “App”) for free (other terms and conditions may apply) 3. Completed the registration and identity verification process.
SWEEPSTAKES PERIOD: Registration for (the “Sweepstakes”) opens on September 17, 2021, at 12:00:00 am PT (September 18, 2021, at 3:00:00 am ET). Entry earning period opens on October 18, 2021, at 12:00:00 am PT (3:00:00 am ET). The sweepstakes period ends on December 26, 2021, at 11:59:59 pm PT (December 27, 2021, at 2:59:59 am ET) (the “Sweepstakes Period”).
ENTRY PERIODS, DRAWING, AND PRIZE DETAILS:

All participants have the opportunity to earn sweepstakes entries. Each entry serves as a single entry into the grand prize drawing at the end of the sweepstakes period.
Entries may be earned as follows:
To enter the Sweepstakes by mail without logging into your HealthyWage account: on a plain 3”x5” piece of paper hand-print your name, address, city, state, zip code, daytime phone number, and email address associated with your HealthyWage account (mandatory), place in a #10 business-size stamped envelope, and mail to: HealthyWage Sweepstakes, PO Box 371, Macedon, NY 14502-03713. Your outer mailing envelope must include a valid return address, which includes your complete legal first and last name. Mail-in entries, including an outer envelope, must be handwritten. Each mail-in entry will be worth five (5) Sweepstakes entries. Mail entries must be postmarked by December 20, 2021 and received by December 24, 2021. Envelopes containing multiple entries will be disqualified. Sponsor is not responsible for lost, late, damaged, delayed, destroyed, misdirected, incomplete, illegible, mutilated, or postage due mail. Photocopies, mechanically reproduced, forged or altered mailed entries and facsimiles are void. Incomplete or illegible entries are not eligible. All entries become the property of the Sponsor and will not be returned. No entries may be submitted on behalf of another person.
LIMIT FIFTY (50) ENTRIES PER ENTRANT, REGARDLESS OF METHOD OF ENTRY.
All information submitted by Entrants will be treated according to Sponsor’s Privacy Policy, available at https://www.healthywage.com/legal/privacy-policy/. By participating in the Sweepstakes and providing any personal contact information, Entrants hereby agree to Sponsor’s collection and usage of their personal information and acknowledge that they have read and accepted Sponsor’s Privacy Policy.
On or before December 31, 2021, all entries earned by all participants over the life of the challenge will be submitted into our grand prize drawing - where one lucky winner will be drawn at random to win the HUGE grand prize! Odd of winning the Prize will depend on the total number of entries received during the Sweepstakes Period. The selected winner will be contacted by the Sponsor (or Administrator) via phone and/or email.
The Grand Prize winner, upon the Administrator’s confirmation of eligibility, will receive a $12,256 USD cash award!
Total Approximate Retail Value (ARV) of prize: $12,256.
WINNER NOTIFICATION AND VERIFICATION: By accepting the Prize, the Winner agrees to release and hold harmless the Releasees, each of their related companies, and each of their respective officers, directors, employees, shareholders, and agents from and against any claim or cause of action arising out of participation in the Sweepstakes or receipt or use of the prize in question. The potential Winner must sign and return to the Administrator, within five (5) days of the date of notice or attempted notice is sent, an Affidavit of Eligibility, Liability & Publicity Release in order to claim the Prize. Note: The Affidavit sent to a US potential Winner will require that the Winner provide their Social Security Number to the Administrator, which will be used solely for tax reporting purposes. The Winner will be responsible for all local, state, and federal taxes associated with the receipt of the Prize. The Winner must note that the value of the accepted Prize is taxable as income and an IRS Form 1099 will be filed in the name of the Winner for the value of the Prize. The Winner is solely responsible for all matters relating to the Prize after it is awarded. If a Prize or Prize notification is returned as unclaimed or undeliverable to the potential winner, if a potential Winner cannot be reached or does not comply with notification instructions within three (3) business days from the first notification attempt, if a potential Winner fails to return requisite document(s) within the specified time period, or if a potential Winner is not in compliance with these Official Rules, then such person shall be disqualified and, at Sponsor’s sole discretion, an alternate Winner may be selected.
By accepting the Prize, where permitted by law, the Winner grants to the Releasees and those acting pursuant to the authority of Sponsor and the Releasees (which grant will be confirmed in writing upon Sponsor’s request), the right to print, publish, broadcast and use worldwide IN ALL MEDIA without limitation at any time their full name, portrait, picture, voice, likeness and/or biographical information for advertising, trade and promotional purposes without further payment or additional consideration, and without review, approval or notification.
IN NO EVENT WILL RELEASEES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND (INCLUDING WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES) ARISING OUT OF PARTICIPATION IN THIS SWEEPSTAKES OR THE ACCEPTANCE, POSSESSION, USE, OR MISUSE OF, OR ANY HARM RESULTING FROM THE ACCEPTANCE, POSSESSION, USE OR MISUSE OF THE PRIZE.
By participating, Entrants release and agree to hold harmless the Releasees from any and all liability for any injuries, death or losses or damages to persons or property AS WELL AS CLAIMS/ACTIONS BASED ON PUBLICITY RIGHTS, DEFAMATION, AND/OR INVASION OF PRIVACY that may arise from participating in this Sweepstakes or its related activities or the acceptance, possession, use or misuse of, or any harm resulting from the acceptance, possession, use or misuse of the Prize. The Winner also acknowledges that Releasees have neither made nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to the Prize.
CONDITIONS OF ENTRY: Use of any automated entry software is prohibited. Electronically reproduced, mechanically reproduced, illegible, incomplete or inaccurate entries are void. By participating, entrants agree to comply with these Official Rules including all eligibility requirements. In case of a dispute as to the owner of an online entry, online entry will be deemed to have been submitted by the authorized account holder from which the entry is made. Neither Sponsor nor other Releasees are responsible for: (i) incorrect or inaccurate transcription of entry information, or for any human, typographical or printing errors, (ii) technical malfunctions, lost/delayed data transmission, omission, interruption, deletion, defect, line failures of any telephone network, computer equipment, software, inability to access any online service or web site, inability to submit the online enrollment form, or any other error or malfunction, or any injury or damage to entrant’s or any other person’s computer related to or resulting from participation or downloading any materials in this Sweepstakes, (iii) or for late, lost, stolen, illegible, damaged, incomplete, inaccurate, undelivered, delayed or misdirected entries for any reason including computer, telephone, paper transfer, or process any transaction thereon, (iv) errors which may occur in connection with the administration of the Sweepstakes, the processing of entries, the announcement of the prizes or in any Sweepstakes related materials. Entry materials that have been tampered with or altered are void. If for any reason, in Sponsor’s opinion, the operation or administration of this Sweepstakes is impaired or incapable of running as planned for any reason, including but not limited to (i) infection by computer virus, bugs; (ii) tampering, unauthorized intervention; (iii) fraud; (iv) technical failures or (v) any other causes such as a Force Majeure (e.g., war, riots, terrorism, civil unrest, strikes, blackouts, supply shortages, order of governmental authority), an “act of God” (e.g., natural disasters, weather, etc.), or an unforeseeable health event (e.g. pandemic or epidemic) which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, the Sponsor reserves the right at its sole discretion, to (a) disqualify any individual who Sponsor believes has tampered or intervened with the Sweepstakes, and (b) cancel, terminate, modify or suspend the Sweepstakes in whole or in part, at any time, without notice and award the prize, if appropriate, using all non-suspect eligible entries received as of, or after (if applicable) this cancellation, termination, modification or suspension date, or in any manner that is fair and equitable and best conforms to the spirit of these Official Rules. Caution: Any attempt by an entrant or any other individual to deliberately damage any online service or web site or undermine the legitimate operation of this Sweepstakes may be a violation of criminal and civil laws and should such an attempt be made; the Sponsor reserves the right to seek damages and/or other remedies from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that or any other provision. Sponsor reserves the right to modify prize award procedures at their discretion.
GENERAL CONDITIONS: By accepting a prize, winner consents to the use of his/her name, city/state of residence, photograph, visual and/or audio likeness for advertising or promotional purposes by Sponsor, and its designees, including but not limited to the posting of winner’s name on the Sponsor’s website(s), in a Winners List or other online announcements, without additional compensation, permission or notification except where prohibited by law. Participants agree to release indemnify and hold harmless Releases from any claims, actions, injury, loss or damage of any kind resulting from participating in these Sweepstakes or from the acceptance or use of any prize awarded. U.S. law governs these Sweepstakes. Notice to online participants: Internet access and usage charges applicable to a participant’s account, including access charges and/or any usage charges applicable under participant’s Internet pricing plan and any applicable taxes will continue to apply while a participant is online in connection with this Sweepstakes, and will be the sole responsibility of such participant. Persons who tamper with or abuse any aspect of the Sweepstakes or website, who act in an unsportsmanlike or disruptive manner or who are in violation of these Official Rules, as solely determined by Sponsor, will be disqualified and all associated Entries will be void. Should any portion of the Sweepstakes be, in Sponsor’s sole opinion, compromised by any means, which, in the sole opinion of the Sponsor, impairs the administration, security, fairness or proper play, or submission of Entries, Sponsor reserves the right at its sole discretion to suspend, modify or terminate the Sweepstakes and, if terminated, at its discretion, select the potential winner(s) from all eligible, non-suspect Entries received prior to action taken using the drawing procedure outlined above.
WINNERS LIST REQUEST: To request confirmation of the name, city, and province of residence of the Winner, please send a self-addressed, stamped business size envelope, by February 15, 2021 to ASC/HealthyWage Sweepstakes Winners List Request, 300 State St., Suite 402, Rochester, NY 14614.
GOVERNING LAW/JURISDICTION: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations of participants or Sponsor in connection with the Sweepstakes shall be resolved as described in the Services Agreement.
SEVERABILITY: If any provision(s) of these Official Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect.
