BMI Challenge Rules

Summary

  • Get paid to lose weight 
  • You must start with a verified BMI of at least 30
  • You must end with a verified BMI of less than 25, one year later
  • You must visit a doctor or participating health club within two weeks before, or on, your Victory Date, which is one year after your verified weigh-in.
 
Official Rules 
 
  1. Your Agreement with HealthyWage
    1. Your participation in the BMI Challenge and the SuperSize BMI Challenge, and related programs, is governed by this agreement. "We," "us," or "our" means HealthyWage LLC, a Delaware limited liability company, and its affiliates (including subsidiaries, etc.). You may be subject to additional posted guidelines or rules applicable to certain content, services, or other items and information available through HealthyWage (which are hereby incorporated by reference).  
  2. Refunds
    1. There are absolutely no refunds.  
  3. Liability Waiver
    1. User understands that there are certain dangers inherent to any wellness plan, including a weight loss plan, and User agrees to assume all risks and promises to hold harmless and not to sue HealthyWage or any of its affiliates, owners, directors, employees or partners for any claim, loss or liability that User may have arising out of the User’s use of or association with HealthyWage or the BMI Challenge or the SuperSize BMI Challenge.  By participating, User acknowledges that he/she has permission from his/her doctor to participate and has determined, along with his/her doctor, that he/she is capable of completing the BMI Challenge or SuperSize BMI Challenge without compromising his/her health.  
  4. Contest Rules
    1. Requirements.  In order to become a BMI Challenge Winner (and in order to qualify for any payment), you must satisfy all of the following requirements (if any one or more of the following requirements is not satisfied, then you are disqualified, you cannot become a BMI Challenge Winner, and you are not eligible for any payment):
      1. You must follow all of the rules described herein, and you must abide by all of the BMI Challenge Rules & Conditions described in this document, and also all of the HealthyWage Terms & Conditions; and
      2. You must have a Verified Starting BMI, as defined herein, of at least thirty (30); and,
      3. You must have a Verified Victory BMI, as defined herein, of less than (not including) twenty-five (25); and,
      4. You must comply strictly with the Weekly Weigh-in and verification requirements, described below.
    2. User acknowledges that technical problems, both on our end and on yours, are inevitable, and a technical problem, no matter how severe or lengthy, will not excuse you from complying with the rules or any of the requirements described in this agreement.
      1. In the event of lengthy service interruption, or other substantial technical problems on the Website, HealthyWage may choose, in its own exclusive discretion, to give discretionary compliance forgiveness.  HealthyWage need not be reasonable in deciding whether to give discretionary compliance forgiveness.
      2. For example, if the User tries to log in to HealthyWage and discovers that the server is down, it is incumbent upon the User to try again later.  If the User fails to try again later and subsequently receives a strike, the strike will not be forgiven; the server failure does not excuse the strike.
    3. Your BMI Challenge starts on the date that you get your Verified Weigh-in (the “Start Date”).  You Verified Weigh-in must take place within 30 days before or up to 90 days after your registration (i.e., the date on which you choose or upgrade your reward level ($100, $400 or $1000)).
    4. The BMI Challenge ends on the User’s Victory Date, which is one year following the User’s Start Date.
    5. Weekly Weigh-in.  
      1. User must:
        1. Weigh-in on the HealthyWage website at least once every seven days, by visiting the website and weighing in on the My Home page.
        2. Not allow more than seven days to pass without a weigh-in.   
      2. If the User has not checked-in by the end of the seventh (7th) calendar day since the User’s last check-in (with the day after the User’s last check-in being counted as the first day), then the User will get a strike.  When you have three strikes, you're out, and you are not eligible for any prize. 
  5. Upgrading Your BMI Challenge
    1. User may pay a program fee to increase the size of User’s BMI Challenge reward.  
    2. There are absolutely no refunds.
    3. The requirements and rules described in these Official Rules apply to all BMI Challenge enrollees who upgrade.  Regardless of whether User enrolls only in the free version of the BMI Challenge, or in one of the paid versions, a User must become a BMI Challenge Winner, as defined above, in order to receive any payout; if User does not become a BMI Challenge Winner, User will not receive any money from HealthyWage and, in no event will User receive a refund of User’s prgoram fee.
    4. A User may upgrade the amout of his/her reward anytime during the first 30 days after the User's Start Date.  User may cancel a previous BMI Challenge enrollment at any time (no refunds) and commence a new BMI Challenge enrollment.
  6. Fraud
    1. If we suspect that you have been dishonest or in any way attempted to defraud the BMI Challenge or HealthyWage, we will not hesitate to involve law enforcement and our own security and investigation team, and we may require additional information and/or verification from you, including, but not limited to, additional medical information, additional proof and/or confirmation of medical information, tracking information, proof of items which you have tracked, etc. In cases of suspected fraud or other malfeasance, the burden is on you to demonstrate that the information you provided is truthful and accurate, and that you have not perpetrated any malfeasance. We may terminate your BMI Challenge participation and eligibility at any time for any reason, including fraud. Further, in the event of suspected fraud, you may forfeit any payment that you have made. 
  7. Definitions
    1. A Doctor is a physician licensed to practice medicine in one of the fifty states of the United States of America.
    2. A Verifier is Doctor or bona fide health club worker or trainer who truthfully and accurately reports a User's weigh-in information.
    3. A User is any person or group of persons using the HealthyWage website, enrolling in the BMI Challenge, or otherwise using products or services offered by HealthyWage, including the SuperSizer BMI Challenge.
    4. User’s Doctor/Verifier Starting Visit is the occasion on which a Doctor or Verifier actually measures the User’s Verified Starting Weight & Height.
    5. User’s Doctor/Verifier Victory Visit is the occasion on which a Doctor or Verifier actually measures the User’s Verified Victory Weight & Height.
    6. Verified Victory Weight & Height are, respectively, User’s weight (in pounds) & height (in inches) as measured by a Doctor or Verifier no earlier than two weeks prior to User’s Victory Date and no later than the Victory Date.
    7. Verified Starting BMI is User’s BMI as determined from the BMI Formula, set forth below, using User’s Verified Starting Weight & Height, as defined above.
    8. Verified Victory BMI is User’s BMI as determined from the BMI Formula, set forth below, using User’s Victory Weight & Height, as defined above.
    9. BMI Formula is defined according to the following formula:  BMI = [weight (in pounds) x 703]/[height (in inches)^2].
    10. Required Stats include weight, in pounds; height, in inches; and date of Doctor/Verifier Starting Visit or date of Doctor/Verifier Victory Visit.
